GENERAL TERMS AND CONDITIONS

These general terms and conditions (“Terms and Conditions”) govern your stay at Atelier Skalo Boutique Hote, hereafter “The Hotel” for accommodation, as well as the use of Hotel facilities and related services rendered by the Hotel to the guests. By checking in and staying in the room, you agree to comply with the below outlined terms and conditions.

1. Definitions

“Atelier Skalo Boutique Hotel”, “we”, “our” or “the Hotel” means the Hotel you are visiting and/or staying at.

“Guest”, “you” or “your” means the person or persons visiting and/or staying the Hotel.

2. Reservation and payment

a. All reservations must be made by individuals aged 18 years or older.
b. A valid credit card is required to secure a reservation.
c. One room night reservation deposit is required and will be charged by the Hotel from the provided credit card. 
d. Payment is due upon check-in unless otherwise specified during the booking process.
e. If your company or agent fails to settle any payment within the specified period or within a reasonable period, you will be personally liable for the payment of your account.
f. Any additional charges for services or damages will be settled upon check-out.
g. In the event of no-show, the entire stay (inclusive of any applicable prevailing Government tax) will be charged to your credit card provided at the time of reservation or as per any revised conditions of booking as per the offer.
h. The Hotel may, at its absolute discretion, cancel the reservation if the Hotel is of the opinion that the reservation information provided is falsified or incomplete.
i. The Hotel is not liable for any losses, damages, costs or expenses incurred by you as a result of any cancellation of the reservation by the Hotel.

3. Occupancy:

a. The room is for the registered guest(s) only.
b. Additional persons not included in the reservation are not allowed to stay overnight in the room without prior approval and payment of an additional fee.

4. Room Key:

a. The guest(s) shall be issued a key for the duration of their stay.
b. Fee of USD 50 will be charged for each lost key. Any lost key must be reported immediately.

5. Check-Out:

a. Check-out time is at 11 AM. Late check-out requests must be made in advance and are subject to availability. Additional charges may be charged.
b. Failure to check out by the specified time may result in an additional night’s charge.

6. Early Departure Policy:

Reservation Commitment:

a. Once a guest reserves a Hotel room, the room is held exclusively for their use for the specified duration of the reservation.
No Refund for Early Departure unless Exceptional Circumstances:
b. In the event that a guest decides to end their stay earlier than the reserved duration, the Hotel reserves the right to retain the full amount of the original reservation.
c. No refund will be provided for any unused nights of the original reservation.
d. The Hotel recognizes that unforeseen circumstances may arise, such as illness or other emergencies, which necessitate an early departure.
In such cases, the guest is required to communicate the circumstances to the Hotel management promptly.
e. Refund consideration for early departures due to exceptional circumstances will be at the discretion of the Hotel management. Documentation, such as a medical certificate or relevant proof, may be required to support the request for a refund. Guests are encouraged to inform the Hotel management as soon as they become aware of the need for an early departure.

7. Damages and Loss:

a. The guest(s) agree to use the room and its amenities with care.
b. A damage deposit of USD 100 is required upon check in. The deposit will be refunded by the Bank after check out. 
c. All the assets and valuables of the Hotel should be duly maintained and should not be damaged or destroyed. The Hotel has the discretion to levy any charges in the future if it is proven beyond doubt that such damage/destruction to the asset of the Hotel (both movable and immovable) have been done or caused by the Guest.
c. A fee of at least USD 100 will be charged for each broken or missing item in the room, on or around the Hotel premises.
e. The guest, upon incurring damages, approves, and the Hotel reserves the right to charge the credit card on file for any such damages or losses.

8. Smoking Policy:

a. Smoking is only permitted in the garden and is strictly prohibited in all Hotel rooms and indoor common areas.
b. This includes, but is not limited to, cigarettes, cigars, electronic cigarettes, and any other smoking devices. 
c. A fine of $250 USD per time of non-compliance will be imposed on each guest found in violation.

9. Safety and Security:

a. The guest(s) are responsible for securing their valuables.
b. The Hotel is not responsible for items left behind by guests.
c. Management and staff work hard to provide a safe and secure environment. We do everything possible to ensure a secure environment is maintained and we ask that our guests do the same.
d. The Hotel takes no responsibility for any personal possessions that are lost, stolen or misplaced.
e. Lost property found on the premises is logged and kept in a secure location for a period of three (3) months. Thereafter, items are either disposed of or donated to charity. The Hotel accepts no responsibility for contacting individuals in relation to lost property.
f. Perishable items retrieved from rooms after check out are only held until close of business that day.
g. Claimed items can be collected from the Hotel with valid identification.
h. The Hotel is not responsible for damage or disappearance of vehicles kept in the parking area. The parking area is not supervised and the Hotel is not responsible for the belongings and valuables kept in the vehicle(s).
i. Guests are expected to conduct themselves in a respectful manner towards other guests and Hotel staff.
j. The Hotel reserves the right to send guests away from the Hotel due to their misconduct and behavior or for any other safety, security, medical reasons. This applies in particular, if Guests do not observe instructions given by Hotel employees, express themselves in a discriminating manner, harass or endanger other guests or Hotel staff. Any disruptive or inappropriate behavior may result in an immediate eviction without refund.
k. No parties of any nature are allowed in the room or on the Hotel premises. The Hotel reserves the right to evict any additional occupants in the room.

10. Waiver of Liability

a. The Hotel undertakes no liability for the shelf life of the food which is taken away to the Hotel after an event at the Hotel or taken outside the Hotel for private consumption.
b. If you have any allergies, sensitivities, or intolerances related to materials such as fabrics, cleaning products, or foods, it is your responsibility to inform the Hotel management before or upon your arrival. The Hotel assumes no liability for any allergies occurring on the premises without prior notice from the guest.
c. While we strive to make reservation arrangements satisfactory, the Hotel disclaims any liability for death or loss, financial or otherwise, travel delays, injuries, damages, additional expenses, or inconvenience resulting directly or indirectly from events beyond our control. Such events include, but are not limited to, flight delays or cancellations, civil disturbances, vehicle defects, strikes, theft, acts of terrorism, natural disasters, war, fire, floods, acts of God, acts of Government or other authorities, changes to Government regulations, accidents, amongst others.
d. You shall indemnify and hold the Hotel harmless in respect of any liability, loss, damage, cost and expense of any nature arising out of, and/or in connection with the acceptance of the reservation and your stay in the Hotel.
e. The Hotel is not liable for failure to perform its obligations if such failure is a result of force majeure, Acts of God, natural disasters, terrorism, or any other unforeseen circumstances beyond the Hotel’s control.
f. If the Hotel waives any rights available under these conditions on one occasion, this does not mean that those rights will automatically be waived on any other occasion.
g. The Hotel reserves the right to change these terms and conditions at any time without prior notice. In the event that any changes are made, the revised terms and conditions shall be posted on the Hotel website immediately.

11. Governing Law:

a. These Terms and Conditions shall be governed by and construed in accordance with the laws stipulated in Curacao.
b. If there is any conflict or discrepancy between the English text of these Terms and Conditions and any translation thereof, the English text shall prevail.
c. Any matter not provided for herein, shall be in accordance with the applicable laws and regulations and/or generally accepted practices in Curacao.
